Yes, in addition to the normal cognitive overhead of maintaining a conversation there is no shared context of the driver’s safety-critical environment—eg the other party can’t see when the driver is approaching a roundabout, a pedestrian crossing, cyclist etc and pause/stop.
Possibly, but then I think "completely legal" hands-free calls are still hugely distracting and should be banned too.
