  • Sorry to read this. What on earth is in the sales pack?

Thanks dude. They say the estate I'm in is subject to significant arrears which my purchasers may find themselves liable for in the future. I'm especially angry about this for two reasons:

    1. it isn't true.
    2. even if it WERE true, our lease is really clear that managing agents MUST take any of their expenses involved in chasing down a debt from the flat in question - they can't on charge it to the whole block in the way these guys are suggesting.

We know this second point because our old managing agent tried to do this several times and they were slapped down by the Tribunal because the lease doesn't allow it.

I think a lot of my anger is directed at myself. I knew how dodgy the agents were, and I suspected they would make some trouble in response to me leading the work to gain our RTM. I should've just waited to sell until we no longer needed to have any engagement with them at all. Not long now at least.

  • What a nightmare! Haven't the prospective buyers read the lease? I mean it's a legal document so if it says in there they wouldn't be liable...

I take it the current managing agents are moving on?

Yup, come May 22 this won't be an issue anymore. I think with the benefit of hindsight and a cost of living crisis looming it might not have been a great time to move anyway, plus the sun is shining and my current flat is lovely in the summer - things could be worse. Appreciate the vent!
