  • i have a queries about shared access alleyways.
I have a terrace house, the access to the garden is shared.
Neighbour has built a drive over the path to the shared access while I have been away.

What can I do in this situation?
Am I allowed to push my drive over my half of the shared access?

They are already quite hostile neighbours as the previous years they thought they were allowed to cut down trees in my garden without permission.
Very frustrating as I work away from home a lot and they are landlords with lodgers and spend most of their time at home.

I have attached a screenshot of land markings.

Any help on this would be amazing, I am a fairly new home owner

    Thank you

Provided you can still use the path they're entitled to do so. It looks as though half of the path is on their land, but presumably you have a right of way over that half. They're entitled to do what they like with it as long as it doesn't stop you using the path.

Don't see why not as long as it's still usable.

    Edit: misread plan

  • i own the shared access too. its 50/50 split shared.
I circled their extended drive in red. ( should've done it in blue)

The drive would only fit one car.
Now they have two cars on which blocks me from using the path.

  • tried my best to show the extended drive and the black line that crosses over to my side of the land
