Nobody overrules the Regulations. There are things which must be in the terms in order for the trader to benefit from some provisions, but you can't reduce somebody's statutory rights.
I was answering a different question for some reason (who bears the cost of returning the item depends on what the T&Cs say).
As Tester says, the T&Cs can't overrule the legislation.
