Anyone leaving a Tier 3 area before midnight was breaking the rules because you weren't allowed to leave a Tier 3 area and stay overnight before 23 December, which was then reduced to not at all. It wasn't a technicality, so she doesn't have a leg to stand on really.
My upstairs neighbour went early last night following the same 'get out before Tier 4' thinking. What this will result in is a greater risk of Covid spread because the longer you spend inside / living with someone the more likely you are to spread it.
If you're going to break the rules there's really no rush.
If she was already breaking the rules then I'm less inclined to show sympathy. But I'm sure everyone on that train in their minds had justified their decision.
