Submitted a Roadsafe yesterday for a driver using a mobile phone and had an interesting call from the police just now.
Apparently even though the video clearly shows the driver holding the phone and speaking they will not be pursuing it.
In a court case a week ago the judge ruled that it is only an offence of the phone is being used for two way interactive communication, so taking a video or looking at pictures is fine. It sounded like future offences may only be able to be picked up by a police officer and not via public submitted footage (I assume because the defendant could just argue that they were not actually on a phone call).

The officer did highlight another offence in the video that I might like to resubmit it for though so it doesn’t seem to be a lack of will on their side.
