I think a big part hinges on Hammersmith IVF not being negligent, and that they complied with industry standards at the time. It sucks (maybe) in this instance, but I think the court decision is based on the fact that they did nothing illegal so can't be liable for damages

Don't see how. It's impossible to prove a conception date, and the patient could easily have been assaulted after that check-up.
