• a question for folks with experience of getting CCTV footage from bus companies:

a work colleague of mine was left hooked by another vehicle right in front of a number 21 bus, the bus driver at the time (the only witness) said that she should be able to get good CCTV of the incident.

after she contacted the bus company (london central bus company) they're saying that they won't provide her with the footage - that it can only be obtained if the police request it 'due to data protection'. at the time of the incident, the police were called but didn't show up, so my colleague has a police ref number but little else.

my understanding was that if you describe the circumstances in relation to the footage you're requesting and they can identify you in the footage after review, they will release the video to you - because you are in it. the bus company saying that only police officers can obtain video footage from the bus companies seems odd to me..?

  • I requested an obtained bus CCTV footage from Arriva in the past month. They emailed me a zip file with MP4 files from each camera of the bus that showed footage containing me.

It's called a "subject access request" and they have to provide the footage to you in line with GDPR rules. This is what my email to Arriva said:

"In with regards to my below report to TFL regarding dangerous driving by one of your bus drivers I would like to request the CCTV footage containing myself on my Brompton folding bike from the number [XXX] bus [NUMBERPLATE] as it was travelling towards [FINAL DESTINATION] on [ROAD NAME] on [DATE} between approximately [ENTER TIME FROM AND TO]."

I was sent CCTV footage within a fortnight, I had to email them photo ID.

  • Sounds like bollocks to me. I guess the only argument against is that it identifies another individual and obviously they won't have consented to the release but I'd say it's reasonable to provide without their consent.

There's a template here for requesting the info https://ico.org.uk/your-data-matters/your-right-of-access/

  • If they has asked for it explicitly stating it is for identifying another person then I believe they are correct as the footage would be personal information. Have they tried just requesting all the footage of them in it?
