But isn't it illegal to use a hand held phone, rather than to be out of control due to using a hand held phone? The differentiation seems foolish. 99% of the time an individual could be in control whilst using it. it's the very generous 1% of the time that causes the accident. So why not a blanket penalty to make having your phone in your hand/lap less attractive?
