I think the law needs to catch up, cases like this are just baffling:
Ms Asker claimed she hadn't seen Seth and only became aware of him on impact. She was on the phone at the time and a number of calls were deleted after the crash, the coroner heard.
Ms Asker, who was driving at around 27mph in the 30mph zone, later said she had no idea how calls had disappeared and said her mobile had been placed in the pocket of the driver's door on loudspeaker when the collision happened.
Giving evidence to the coroner, she said: "I did not see him. I could not do anything.
"I had my side lights on as it was beginning to get dark. My phone was on speaker phone as I had no hands free in the car.
"I do not think my driving was impaired by being on the phone. It would have been no different to a passenger sat next to me talking."

Not really. A passenger can see surroundings and adjust when they talk to the driver, and it's easier for the driver to tell them to be quiet when they need to concentrate more. Also speaker phone driving usually involves fiddling about with phone angles, adjusting volumes, "sorry I can't hear you very well, one sec.... is that better?" etc etc. Not the same as a passenger.

Yes I have. No contact made and no footage of incident hence the initial reluctance to report to the police.
I'm fine, old and ugly enough to have dealt with this kind of thing before, although his absolute rage did give me enough concern that he may follow through with the threats to hop onto the kerb behind a lamppost...

I was thinking more of distraction by just talking to the passenger alone, but all that additional point is valid.
What do I know? I usually use sign language with the drivers.

I think its just a clever defense in court. But I call bullshit to it being in the passenger door. Phone on speaker only really works when its out in the open, which most likely means her lap.

More likely on her hand, holding the speaker part of the phone close to her mouth, a lots of people seemed to think that's a grey area.

Well, I guess you'd pick objective measures impacted by being at a certain level of drunk, and then compare the same measures when driving whilst using speakerphone.
I'd rather it was recongisned that speakerphone / handsfree is just 'fucking dangerous' though, and that they were outlawed. There's shit loads of research backing this stuff up from loads of different fields.
But that would mean listening to 'experts', and, well, we've had enough of them, and child killers like Asker obviously know better.

Currently in Spain, you're only allow to use a true hand-free phone, so a mobile phone with speaker on is illegal, not only that, listening to an mp3 player is also illegal.

When the phone was dropped it must have unlocked the phone, gone to calls log and deleted the most recent calls.

Hope you are not too shaken up, these incidents are unacceptable but also very frightening.
