What to do in the case of an accident (discussion)

  • I've emailed uber and they've been quick to get back to me - not surprisingly if driver is liable and I could get claimsdirectinjury4u or the like on to them.
Thankfully A&E visit didn't come up with any fractures or ligament damage so just muscle damage.

  • @ojeffcott

Perhaps it should be suggested on this thread http://www.lfgss.com/thread4213.html to take photos of any damage.

I did not do this when I got hit last year, instead I got two quotes to replace damaged items and submitted them. The driver's insurance are now asking for photos that I can't produce and the bike parts were all binned/replaced as I needed to get it back up and running asap.

  • Was it assessed by a bike shop following the incident?

  • two different bike shops

  • Weird, I don't see what their problem is then. You had is assessed by two independent 3rd parties who confirmed the extent of the damage. I don't think it's then reasonable for the insurance co to ask for photos further down the line...

  • Is the info here still useable? Sorry for being ignorant but I've never been in an accident before where I need to get the law involved.
I got hit by a white van at upper street yesterday, Theberton Corner. I'm on my way to Highbury and islington from Angel and White Van was coming the opposite direction turning right to Theberton street. I saw him indicating but I was pretty much in the crossing already so I went ahead only for this guy to keep on coming without stopping to let me through.
Long story short, I got hit and taken to Royal London by an ambulance. Police took a report from the van driver and they gave me his details. I never got the chance to speak to the guy as I was pretty much on the tarmac the whole time. 2 broken ribs, bruised kidney, and aching right arm. Broken Bike. I got discharged today as I was told that hospital cant do anything else as the bones will heal itself. Gave me loads of painkillers.

Police told me to call the van driver once i'm feeling better, but I was advised by other people to seek solicitors advice before calling the driver. Not sure what to do, any advice?

  • Lawyer up! Will take time, and you may need to harass them to get them to do their job properly, but you'll be compensated properly for your pain, broken bike and any loss of earnings.
Think Leigh day are the solicitors of choice on the forum. Or become a member of LCC or CTC and use the legal team from either of them... Well worth the membership fee...

  • Don't call the driver.

Advice here is good. I'd get lawyered up in that situation. Let them deal with it. You don't want to be dealing with the person that hit you direct, it can cause issues later in the process.

I might be asking the old bill what they are doing re charges too.

  • Cool, thanks guys. Going to check Leighday and CTC. They help you even if you're not a member it seems. Will be calling the police to see if there are any charges made against the driver.

  • Called CTC Slate and Gordon and they accepted my case. They said they dont take cases they know they wont win and pretty confident that my case is pretty much a win already. Will need a medical check from them which will be within the week. Really friendly people and very helpful. Actually felt that they do care about what I have to say. Doesnt happen all the time.

  • Forumenger ojeffcott works for them, perhaps you spoke to him?

  • Spoke to a guy named Davita or something like that, really friendly and took the time to answer my questions.

  • Hope your alright brother. It took about a year and a bit for my case to close, you will have to jump through a lot of hoops but will be worth it in the long run. Also, keep any receipts for travel, medicine or anything else you buy/use due to the crash. You can claim it all back.
    Heal up fast !

  • so a truck driver opening the rear door of his truck didn't look before he opened it and clipped me with it as i rode past.

Some superficial damage to my left shifter and a huge bruise / graze up my forearm. I took his details and a guy behind me offered to be a witness, got the delivery company details and truck registration.

I eventually rode off, just before i left he asked me how much it was going to cost to repair my shifter i said i didn't know but i was more concerned about my arm what with riding the 100 on sunday.

He said he would rather sort it out personally as he'd only worked there a week and didn't want to lose his job (could be BS)

Not really sure what to do, currently sat at work icing my arm

  • get details, report to police and make claim against his insurance.

    lawyer up

all is detailed at the top of this thread

  • What do you do when knocked off your bicycle by a pedestrian.

Tourist. They were looking at their phone and just stepped out of nowhere into the path of my gf. Sent her flying :-(
She says she's okay and the bicycles okay, but what do you do when it's not okay.

  • Have insurance in case of serious injury to the third party.

  • I believe @ObiWomKenobi has experience with this.

  • So after 13 years of commuting in London I had my first accident today... I was on my beater merrily plodding along in a bus / cycle lane when all of a sudden the Merc in front decided to turn into me. He hadn't indicated and although I slammed on the brakes and took evasive action I smacked into his left front wing, went over the handlebars, did an aerial 180 and went flying / sliding across his bonnet Dukes of Hazard style. Somehow I landed on my feet and apart from some minor grazes on my legs from my pedals emerged unscathed. Likewise my steel beater (steel is real) also survived undamaged apart from a slight kink in my front wheel.

The driver immediately stopped and got out to help, he was very apologetic and admitted he hadn't checked his mirrors and took responsibility, plus coincidentally a police car had been right behind us and seen the whole incident. The officers checked I was fine and asked if the bike was ok. Seeing nothing more than the slightly wobbly wheel I said yes, spoke to the driver, exchanged details and parted company.

So all in all a lucky escape, the only annoying thing is I've now had a chance to get home and dust myself off. Physically just the bumps and grazes I mentioned before but I discovered the screen of my phone which was in my pocket has cracked.... obviously this is minor in the scheme of things, but presumably I should tell the driver this and get him to cough up for the repair? He repeatedly offered to pay for any damage to the bike so I don't think he'd mind. As I say he was very good about it and threw his hands up for causing the accident.... so thoughts please?

  • @mcmyk - In your case I would just ask the dude for around £500 or do the insurance route even though it would take a while to get comp

@GreatSince78 - I would 'get details, report to police and make claim against his insurance.' as dj mentions above

Holla at Leigh Day, they will sort you out

  • Glad to hear you're alright mate. You don't have much luck with phone screens, do you?

  • I hope the driver's details are legit. The police should have checked them at the scene.

  • Haha, oh mate, yeah nice shiny iPhone... thanks very much though, I was oddly calm at the time, maybe because the driver was an older fella and was clearly really shaken up, he could barely write down his details. Plus my old steel beater had made quite a large gash in his shiny motor! Definitely counting my blessings....

  • Thanks, yep regretting not taking the details of the two officers who witnessed the whole incident, but have the drivers details so hopefully it'll all be fine... such an odd crash, bright sunny day, totally dry conditions, not much traffic etc, and nowhere to go where he turned in other than the forecourt of a closed car tyre shop.

  • Good point Howard, he gave me his business card at the time though, so I rang him (the mobile number on the card) from my work phone and saw him get the call, so I'm confident he's legit. That's the thing, he was a doddering old guy, and was frantic with guilt (probably partly due the police being on the scene) so frankly I was more concerned he was going to drive off and have a coronary at the wheel.
