How many teeth on the top sprocket?

8, 9, 10 or 11 speed?

10, not sure on the teeth, not by it right now

Just a thought but if the top sprocket is 11t, then a 12t should stop the chain rubbing the stay.

Have you measured the OLD? The stays may be a little splayed.
