  • No.

  • This involves a colnago where is @Saarf ?

  • Please, please, please.... Never pay for anything via gift or bank transfer.

This is in the forum rules, but I think perhaps it needs to made more prominent.

    Basic rules for classifieds:
    [ ... ]
PayPal transactions must include buyer protection (sellers are not allowed to demand that money be sent as a "Gift" as this deprives the buyer of any form of protection on their payment).

  • Yeah, I know. Just reiterating.

  • A.Ma.Zing.

    @ColnagoDaft - top comedy. Bravo.

  • I don't think so. He sent me the frame at least. He's no massive fraud, just a really,..... REALLY bad trader.

I'm actually waiting to see if he's going to take this to court.

It's peculiar. There's been no admission that maybe he miss-sold in his ad. Not a shred of humility.

  • I did laugh when that one came through.

  • Anyway. It's the weekend. Hooray!!

  • Phone double post.

  • here, but i fear my special powers are of no use here

  • Still Amazing.

  • Guy is an epic fuck nugget, the small claims court will ask the means of payment and then be linked to your paypal dispute. I'd personally travel up and put in a counter claim for train tickets and a b+b.

  • @Thoma are you safe?

  • Ha! Yeah. I'm good. Thanks for checking in though.

I'll definitely go if the summons turns up.
He said he'd collect next Friday. Even told me "that's a promise". I said I'd have I boxed and ready for him. I have it in writing.
Not sure how that's me withholding his property. Which at this time I've paid for.

  • I wouldn't allow the cunt that has been threatening you to come and collect. Return it at his expense.

  • I can do a door to door delivery, it'll cost £2k and a mink coat.

  • He's threatened you with physical violence and you are okay with him collecting from your house in person?

  • I was calling his bluff but in court either he's promised to collect or he's threatened me. It's one or the other and it's in writing.

We have a reception which I'd be happy to leave a package for him to pick up. It's not like he doesn't already know where I live.

Thanks @dancing James, I'll pass on your pricing.

  • Don't relinquish the frame until the PayPal claim is finalised.

  • This.

Also what has been said about not having him collect it or even making that an option.

Also if the original packaging was damaged at all in transit(?) grab an old wooden pallet and place the bike box on that then explain it's being shipped by pallet in the hope the goods aren't further damaged. As a downside to this shipping a pallet is far more expensive for the other guy but I think what we all want here is the goods to arrive back safely.

  • A lot of good advice being given here in response to @Thoma 's issue.

I've ended up with full refund plus keeping the item numerous times because a seller has been too stubborn to respond through Paypal. I'm pretty sure the standard operating procedure for Paypal is that if the seller doesn't respond or doesn't respond satisfactorily, they just issue a refund, claim the funds back from the seller and forget about the item.

Haven't had any issues since Paypal and eBay split but I've always pursued any claims through Paypal, just makes sense since that's how I paid.

I believe pursuing a claim through ebay usually requires return of the item at buyers expense regardless of whether or not the seller is at fault before any refund is issued. I'm pretty sure the standard operating procedure for Paypal is that if the seller doesn't respond or doesn't respond satisfactorily, they just issue a refund, claim the funds back from the seller and forget about the item.

  • It's all gone quiet. Too quiet.

I think he may actually go through with the court thing.

  • How? Currently you have the frame and PayPal is holding the money until he responds?

He would be a lunatic to go to small claims as things currently stand.
