This last part is off to me. You're saying that it's ok for the driver pulling out to make an assumption about the approaching car's speed ( that it's within the limit), when really the driver should have assessed the speed of the approaching car and made a decision based on that.
It's the exact same situation as when you're approaching a junction on a bike and a car pulling out makes the assumption that because you're on a bike you're travelling slowly and continues to pull out right when you're on top of them.
Regardless of whether the lambo was speeding, if the driver of the car pulling out saw it coming, then it's still a dumb move by the driver pulling out.

In the real life, when driving in the urban environment you have to be assertive or you will be stuck. People do pull out, but any normal person have enough time to slow down. There are also many junctions where you can't see the approaching traffic in time if the cars are speeding. Simple as that. That Lambo's driver is a certified idiot.
