Where there is a contract for the sale of goods by description, there is an implied that the goods will correspond with the description.Section 14.2
Where the seller sells goods in the course of a business, there is an implied term that the goods supplied under the contract are of satisfactory quality.Most importantly Section 14.2b
For the purposes of this Act, the quality of goods includes their state and condition and the following (among others) are in appropriate cases aspects of the quality of goods—
(a)fitness for all the purposes for which goods of the kind in question are commonly supplied,
(b)appearance and finish,
(c)freedom from minor defects,
(d)safety, and
(e)durability.Item d is probably relevant in ChainBreakers case also.

The ALPs approval rating shows that they will not win another election and they are now currently leaderless as Gillard has no mandate from the party and Rudd is not PM yet. In order for Rudd to become PM he will need to be recommended by Gillard to the Governor General who will approve the decision he will then face a vote in parliament which is reliant on independents voting to approve him. If that vote fails there will be another election. If Gillard refuses to recommend him who knows what the fuck will happen.
Gillard has pledged to retire from parliament but even if she does not she is likely finished.
He is the Prime Minister Designate. Gillard has recommended to the GG that Rudd be installed. It is unlikely that the GG would contravene that recommendation, though she could.
The vote in Parlaiment will only occur if ordered by Bryce, or if Abbot puts a No Confidence motion. He wouldn't answer the question of whether he would (because he's a snake), but implied that it may happen if Rudd delayed the election.
Or something like that...
