deceived me as a seller and got of his problem
the fact he was being a douche about it annoyed me more than the actual fault with the bike

well the cycle shop attempted to tighten and put the crank back on but fell off right away - would not tighten or actually sit back onto the groove

The pinch bolts do not tighten, they are also worn out the allen key will sit and once you attempt to tighten it comes right off
Ahaha that's what I thought but its fine, he had taped over some parts of the bike mainly the places where the names were.
In terms of actual damage to the frame didn't find any, just the crank as it stands
