I can't think of any kind of insurance you can take out that will insure you against having to pay out if you commit criminal damage. Who would insure someone against the risk of them committing a crime?

i would imagine a the small claims court would be the way to go.

It's like an armed robber being insured in case he has to pay out to the security guard that he shot.

have you spoken to a solicitor about getting him to pay?

Maybe the court will award you damages when the case is heard i.e. a sum of money to cover the cost of repair / replacing your bike. The hard bit though is likely to be actually collecting the money, depending on his financial situation. If he's potless then you can probably forget it I'm afraid.

The guy is under 18, so his parents have to be fully involved, and that MCOL looks lengthy, then again I spouse any way of approaching this will be.
-

Maybe the court will issue an attatchment to his
earningspocket money for any damages applied... -

^ sorry, probably not helping.

The court can demand he pays damages if convicted (he will have already been charged if going to court) but if he/his parents are/claim they are broke this could come out at £1 a week or whatever they can convince the court they can afford.
If this happens, I'm not sure of the ramifications on your potential insurance claim

This is bullshit, literally bullshit.
I can totally see why someone would want to drop all charges and deal with it themselves.
Fuck sake. -

What is the extent of the damage to your bike?
-

Chainring smashed into the frame, chainring bent, multiple dents, wheels wobbling like jelly on a plate, biggest dent in frame where it hit the bar it was resting on. That kinda thing

Can't the court just order he pay damages?

Never tried it, but they can:-
http://www.cps.gov.uk/legal/s_to_u/sentencing_and_ancillary_orders_applications/#a01My only experience is with Restitution orders, although have never been very successful, as a result of the other side not having any tangible assets

I would listen to Tiswas. Them's good advices. When you claim on your insurance, you should tell them about the criminal case and give them the crime reference number. That should keep it off your record and from affecting your no claims.

Unfortunately it's a no-claim bonus, not a no-blame bonus (if you have one, not that likely with household or cycle insurance). Telling them it's because of a criminal act and not your fault might stop them loading the premium because of the claim, but sadly insurers believe that if you've made one claim, you're more likely to make another, so they charge more ...

Broadly agree with this - most of the mass market Insurers would load a premium due to claims history

If they are under 18 expect a very long drawn out process that will ultimately end in a50p a week payment. uk legal system is crap for dealing with youths, probably why we have so much problem with them.

Claim the insurance, change the insurer, then go round to his house dig an open grave on his front lawn.

I would avoid MCOL as it limits the detail that you can put in for the particulars of claim.
That's incorrect. You can serve extended particulars separately by post.
Hey there,
On Sunday night in Kingston Upon Thames, my bike was smashed around by someone after a fight broke out between people I was with, and people he was with. My bike was directly outside Kingston police station all on camera. He knew I was at the same place earlier at the same time and saw my bike as my transport home and something that meant something to me, as I asked him to step away from it.
After being held back while he had a go at it, the young lad was arrested for "criminal damage"
He pleaded guilty in the little interview he had while I gave my statement.
He is now going to a court case to "officially" plead guilty, then he will be charged.
He has a history with the police this is why it is going to court.
I have a crime number in order to get in contact with my insurance, but in previous history of goods being stolen and insurance has paid out, the quote a year on has rocketed due to my claim. I do not want this to happen again.
Because I have my bike back, and he has pleaded guilty, cant his insurance be evolved in paying out?
What if he has no insurance, what happens then?
Where can I can funding from (if I can get any if this is the case)
If he does has insurance how do I go out contacting them etc.
Any advise would be great has I have never done this kind of thing before.
(I am containing myself still from expressing my true anger towards this fucking behaviour I hope you can all appreciated)
Thanks a lot.
