Follow roxys instructions
everyone here should read them as there is actually a lot to do when the accident happens
they also help you be much more useful if you witness an accident as well
heal up fast and sue the fuck out of the driver

i was on london road leicester, not going very fast, the road is kind of split in to 3, the lane i was in going into town, the next lane is a road for motorists turning right. the car that hit me turned right without looking for me and i went over the bonnet and landed about 10 feet later.

Firstly call the police now (as in immediately to report the incident). Then call the A&E and see if there is any useful information that the ambulance crew may be able to offer (witnesses etc). Finally, call a legal firm for advice. If you're a member of the LCC, call them first to get the free legal advice. Otherwise call an ambulance chaser to begin with.
In theory, when an ambulance is called to the scene of an RTA then the police are supposed to attend as well so hopefully they may already have some information. Do ask them about this.

There is no need to sue the driver as you can make a claim against their insurance for any damage to bike, equipment, and yourself.
I'm assuming if you were unable to move around then an ambulance took you to hospital, in which case they should have contacted the police if the driver hadn't already. I believe you are supposed to inform the police whenever a collision occurs (may be wrong though).
Take photos of bruises etc. tomorrow, or whenever they come up so you have evidence of injuries etc. Go to your doctor so there is a permanent record of these injuries (as well as a professional opinion of the severity). Get the bike checked over by a bike shop, and get a quote for repairs. If you tell them it's for an insurance claim they should type it up on headed paper (may charge for this service but you can claim that back as well) so you can forward a copy to the insurance company. Keep a record of all expenses incurred due to not being able to use your bike (reciepts for taxis/bus tickets etc.) as you can claim for those too.More importantly, get well soon! I'm sorry to tell you this but it'll probably hurt more tomorrow when the adrenaline has worn off :(

who are the lcc?
The London Cycling Campaign. As you've said that the accident happened on London Road, Leicester I'll guess that you're not a member. Instead contact Cycle Aid from the accidents thread (It's in the first post).

I don't want to go down the claims route. If I can speak with the driver and she's willing to fix what's broke then that's cool
-
• #17
That is making a claim. You are asking for compensation for damage. You might prefer to do it informally, she might not wish to or may take the informality of your approach as an indication that you will not press your claim and therefore call your bluff and ignore you.
Heal quickly.

Also, she will be insured. If you are hurt you are entitled to compensation. Take it. Give it to charity, blow it on a new bike, have a holiday or whatever. You've been hurt when you shouldn't have been.

and further, you will find her insurers very willing to resolve matters swiftly. Contact them.

Sorry to hear this, hope you heal up soon.
Definitely make a claim though, as has been said, the money will come in useful.
Good luck. -

damn, sounds bad! ihopefully you got some witness details, ime they can make all the difference.
good luck mate.

update if anyones interested, 3 witnesses confimed she was driving without due care and attention. she was interviewed under caution. ive got her insurance details and am going to them to request money for what needs replacing. or should i start a formal claim with a solicitor???? i kind of want to keep it clean and not have to go through the solicior route even though its highly probably. anyone else dealt with this.
on a funny note a taxi driver who i got chatting to last night rang his 'uncle' whose a claims solicitor and told me allsorts of stuff to say.
-
• #24
No need to get legal advice unless she is going to deny any wrongdoing to the insurance company, if she admits it was her fault the insurance will pay out. If not (and she would be pretty stupid to contest it) then you have 3 witnesses who will back up your story. That should be enough for the insurance company. If they still refuse then I'd be looking for legal advice.

Have you priced up the cost of replacing/repairing the bike, and all the other bits that were damaged?
it hurt, alot but are there anythings i need to do/write/say to the police as no ones contacted me. got taken to a&e patched up and sent home but my bikes fucked and so is my helmet, jacket and computer that was in my bag. any advice on what happens next, or what i should do appreciated.
