  • OT, sorry, but a worrying case I frankly can't understand at all.

    My God, that is horrible and shocking. It's pretty clear what the judge thinks of Mr Stubbs.

    Parents often fail to see the foibles of their children. I can only presume this is the case here.

  • this is part of the silent culture that maintains status quo of cyclists being'lesser'road users. until there are clued up lawyers prepared to stand up and mention the insufficiency of short bans and fines for deaths, we will continue to be regarded as an insignificant minority interest and not equal in eyes of the law.

  • Even without Mr Stubb's contribution, the case is worrying. There is simply no way a motorist in a cab where the noise is the same as that in a saloon car, could fail to notice a cyclist beating the front of the vehicle. It couldn't happen. You'd hear it and see it. The driver had broken the law by driving without a break since 5am, the cyclist was an experienced tourer. On the balance of probabilities the cyclist was blameless.

    The driver was asked 5 times by the cops how the bike could have ended up in the undergrowth. He had no explanation.

  • so what if you kill someone with your car you wil only get a coupple of years but if you do it without a car you will get many more, that seems to be the norm i keep seeing. Careless driving? BS!! I think manslaughter should apply whether you are in a vehicle or not.

    I think a serious petition is needed to combat this continual crap.

  • There have been at least two recent cases where drivers who killed cyclists weren't charged with anything:

    The 3rd July was the first anniversary of the death of Berkshire cyclist Anthony Maynard, who was run over from behind in 2008 by a van driver who claimed in his defence that he didn't see Anthony. Another cyclist was seriously injured in the incident.

    Reading Crown Prosecution Service decided not to prosecute the driver.
