Sale of Goods Act - pertaining to PC games?

  • Anyone know what the go is with PC games being returned, as I bought Dead Space yesterday, and despite my system being able to run it (by the minimum specs) it won't run properly - I messed about for hours - downloaded riva tuner to try and tune the graphics card - no joy....tried everything I could think of - system processes, running it at lowest FPS, you name it.....

Their are countless complaints about the same issues that I am having all over various forums etc.

When I bought it from Game Station the assistant asked me if my PC could run it and that I would not be able to return it? That can't be right though? Surely if my PC meets minium spec and it still can't run it, and many people are saying the same, they have to refund don't they?

    I see!

  • video and sound lagging and mouse lag specifically - although when the sound gets into an infinite reverb loop, it is quite tempting to turn the lights down low, put the lava lamp on and build one!

  • Because everyone buys games, copies them and returns them he was probably trying to scare you out of returning it.

If it doesn't work, return it. Don't leave until you have a full refund.

  • what gear ratio is it?

why not ask on a PC gaming forum?

  • The clue's in the name

'Game Station' can not change British law ad hoc, the cashier cannot legislate.

Take it back, don't except anything less that a full refund, regardless of what they tell you.

  • i think software might be an exception...

also, 'minimum requirements' are always to be taken with a big pinch of salt. they mean' the absolute bare minimum to get the game running' not running smoothly, or well, but just enough to load it.

  • what gear ratio is it?

    50/14

get you with yer bad self - cheers, I'll give that a go.....

You could be right. Apparently software is not "tangible goods".

Fuck you Mr Government! I'd like to see you twiddle your thumbs for days on end to produce a jumbled pile of bugs, issues, errors, problems and exceptions! Course it's a fucking tangible product you bunch of Bentley driving monkey fisters!

  • "tangible moveable item" could include the DVD and box then. Sorted.

simple solution, buy an xbox or ps3

They have just as many problems. You have to download patches and updates for games all the time.

  • insist, and make a stink, right there in the shop.
Before you know it the manager is there, wishing you to be gone quick !, and he'll give your money back to get you gone !
    works for me :)

  • I work in HMV and there policy is too exchange PC games if product is sealed. Mainly because a lot of newer games require registration to play the game (Spore, Football Manager 2009), something that can only be done once. Thus if we accept a game back for resale that has been registered before it won't work again.

Making a stink makes you look like a twat in my opinion. We have clear signage that states our return policies yet people seem to conveniently ignore them. Sorry if I sound aggressive but I work in Canary Wharf so on an hourly basis I am confronted with over-paid bankers who want refunds on stuff they have clearly watched or demand some sort of discount because they work in the looming tower above me. Cunts.

  • Software usually lists a minimum spec and a suggested spec which is a fair bit higher and enough to ge tthe game runnign fairly smoothly.

If your machine matches the suggested higher spec and still fails, then you clearly deserve a refund.

  • Sale of goods wrt battery packs?

    Handtec have said:

"Unfortunately given the length of time that has passed since your original purchase we are unable to accept your request. These items are advertised to have up to 20 hours but this very much depends on usage. Please contact Garmin if you are not satisfied with the performance of the product. "

I only bought the packs this month! They don't even last half the claimed 20hrs which make them useless to me for my long rides.

How do I get my money back?

  • The retailer has the responsibility to replace / refund, not the manufacturer.

    Tell them to do one.

You can inform trading standards and take them to court, or make a chargeback on your credit card.
