Just as an aside to the above, you should use the **Data Protection Act** rather than the Freedom of Information Act to apply for CCTV footage. You should make a data subject access request under Section 7(1) of the DPA.
The Information Commissioner's Office provide a template for requests. The CCTV Code of Practice outlines an organisation's responsibilities for disclosure in section 19.2 (page 15).
Also, you should use the Data Protection Act (not the Freedom of Information Act which does not apply) to access case details from the police. However, the police can withhold information in certain circumstances.

Or just scroll to the bottom and phone Birmingham City Council's lawyer - his contact details are there.From a brief scan it looks like the DPA does not usually apply to traffic cameras bacause they do not fulfill the conditions in chapter 5 - zooming / panning; commercial use; and something else.
Good luck making Brum a safer palce for cyclists.

People were driving terribly last night. In fact, quite a few of us commented on this on our hill ride. What the hell has got into people? Perhaps the fading light and grey mornings?
They need to waken the fuck up and pay attention

I agree with mike. Worsening conditions = worse driving, because the degree of skill required to function "normally" at it increases.
Which is why it appears that all the nutters come out as soon as it rains/snows/gets dark early etc. In my opinion. -

I'm really sorry to hear about this man. It sucks that people do this.
So ive spent the day chasing it up. The city council have footage, but they claim they are only allowed to provide it for police or courts because it contains 'other' people.
Unfortunately this is in fact the case. It came about when a man was photographed by a gatso with a woman who wasn't his wife in the passenger seat, causing a divorce, etc.
Anyway. This is what cyclist need to do, absolutely chase down this kind of stuff... another good reason to have a helmet camera!

Stress can manifest itself in bad driving particularly when the driver's mind is elsewhere. For this reason, the present economic climate requires additional caution when riding.
That said, the economic climate could act as a catalyst for safer roads and it is beholden upon us to make this happen.
Put simply, as you know, research shows that the more cyclists there are, the fewer accidents there are. In economically gloomy times, how better for people to save a few quid than getting out of their cars or off the trains and tubes and cycling. We need to encourage colleagues and friends. Advice, encouragement, demystifying the dangers, making cycling inclusive rather than an exclusive tribalistic practice, can all help. If women want to ride shoppers or middle aged men wish to ponce around on (dare I say it?) Bromptons, encourage them to do so.
At my firm we have doubled the number of cyclsts in the past 12 months. We provde twice as many showers and more secure bike parking spaces. Other steps have been taken including a Rollapaluza eveining for staff and a real push on the London to Brighton ride where we had 100 riders and a barbeque for 250 on the beach. We regularly have the City Police in to talk about safe riding. In my own department we have gone from 0 riders two years ago to seven regular riders today. We need more.
Think how you can persuade one or two people or even more to start to ride regularly. It will do them good. It wll do us all good. If we each managed to get a couple of people onto the roads over the next tweleve months and they in turn persuaded a couple more peoplle over the follwong year, we would soon have areally safe city in which to ride.
The economic downturn is a real opportunity to achieve this.

I'm being realistic here, not negative, but you're not going to get anywhere with this.
You're angry now, and rightly so, but we all know the system and how it works, and it'll be one headache after another.
Props to you for trying to do something positive by attending this meeting, but the CCTV stuff and making an allegation of attempted murder isn't going to get you anywhere.

Yes, charges may apply. The appropriate limit specified in the regulations is £450.00. This represents the estimated cost of one person spending 18 hours in determining whether the department holds the information, and locating, retrieving and extracting the information. Consequently, the Council is not obliged by the Freedom of Information Act 2000 to respond to your request see section 12(1).
Does not sound good, makes me think they will charge the full £450 to avoid doing it, back on the phone then!

Unfortunately I think you already need a healthy cycling population/culture for that to occur.
On most rides I take im lucky to see one other cyclist. This is a car city, designed around cars. In fact the location of the incident is the former site of a Birmingham Indy street race.

Glad to hear you’re ok Deadly. That behaviour has to shake you up some, put it down to stupidity and ignorance not mal intent.
IMO the downturn in the economy will push more inexperience riders to the roads and make less money available from the governments to spend on improvements, a reduction in insurance payouts and fewer legal actions.. In scientific speak - less of stuff that requires money.

did you mention this happened in Belgrave Middleway? i know that roundabout well. wide and fast flowing from all directions. three lanes in a roundabout without traffic lights will be tricky for any cyclist.
brum is sht for cycling in general though. not enough cyclists means drivers are less likely to look out for cyclists. roads are tighter than london and have loads of chav fcked driver/passenger that will yell or throw stuff at you.

I also found this funny. I even tried to come to dfp's rescue on another thread on Sunday night. The hyenas normally only attack at night but there seems to be a special breed on the forum. No one is safe, I also felt the bite ;)

Riding around yesterday was well hairy, had three near misses in total. Everyone was driving fast, totally unreadable, in a apocolyptic way.
I was involved in a very scary life-threatening incident, where a car accelerated around the inside of a roundabout on my right went past me and turned left into my path without slowing.
The appropriate place to turn off was about 10metres behind me, yet it sped up to go around my front , suddenly veering left & almost ending up on the embankment as I was nearly past the exit.
I only avoided the collision by turning left with the vehicle as it came into my path, braking/skidding wouldve ended in bloodily.
I called 999 at the time, gave the plate etc. They said theyd keep an eye out (yeah right!) but in shock I wasnt thinking with my usual rapacity so I left it at that.
Today I realised it was pretty much an attempted murder and that I hadnt actually even made a proper police report.

I was sure there was a privacy law entitling any person to request a copy of video footage they are on? - does anybody know more about this?
Anyway, so I pressed on with various departments of the police. It turned out my report was not registered as a report at all. They told me they could not look into the matter unless their had been a collision. I had a right go at them, telling them I was on a bike, and that if their had been a collision , I would be dead!
I managed to get them to foward a request for a police report to be made, and also request footage. But ONLY by claiming it was a clear motivated attack, an attempted murder using a vehicle as a weapon. They simply would not even register it as dangerous driving, or make an official report unless there had been a collision! - cunts!
Im going to a meeting about promoting & making cycling safer in the city tommorow (Birmingham) and although even in an ideal situation it would be difficult to get hold of footage that quick. But its an example of how the footage could be extremely useful, as well as for trying to chase up prosecution for the incident.
I dont have any faith in the police system, especially regarding anything bicycle related. they told me I may be contacted in 2-3 weeks to make a report!
I would very much like to get hold of the footage ASAP and try and do something useful with it.
Does anybody have any advice?
