Damage and councils

  • Has anyone successfully claimed from the council for damage caused by bad roads? If so can you tell us how you did it or have a sample letter :-)

  • There was an article on some news web site, maybe BBC news, where a guy claimed damages from a council because the pot hole was so big and it buckled his rear wheel. So it is possible. The cyclist-haters said that we shouldn't be able to though, because we don't pay road taxes. :S

    Yep, but I thought 'road fund license' was used to maintain the motorways and council tax used to maintain local roads, so cyclists have as much right as anyone.

  • reading that it almost sounds like you have to report the damage to the road,and give them a chance to fix it before you can claim. Strange then they could say if you knew it was damaged why didn't you avoid the problem. surely its more likely " I was riding along and I fell into a bottomless pothole I didn't report it in advance because I didn't know it was there.".......

    it ISN'T 'road tax'. it's car tax. Vehicle tax to be more specific, and the revenue that comes from it is NOT used to maintain the highways.

    tell that to the next motorist that tries it on.

  • there's a nasty one on the Brixton road, in the bus lane, near to BC and the stockwell skate park. didn't see it, hit it, found out my stem wasn't clamped tight enough to hold my bullhorns up, nearly ground my nose off with my front tire, all in that order. no damage thankfully.

  • Road tax was abolished in the 1930's. the current system is based on carbon dioxide emissions. i might wheeze a bit on the big hills but i'm sure i don't produce as much as a grand cherokee.

    local taxes (council tax is the biggest) pay for the roads. i'm sure we all pay council tax.

    most cyclists probably drive too - i do so pay road tax anyway.

    i've managed to bend both wheels on a big hole last week - arse!

    I find it much more difficult to avoid potholes when my wheel is 5" from the back of the bus.

    re:road tax. I do pay it. I do own a car, i don't see my paying tax on it as a 'right to drive cunt like' permit. i see it as a yearly question "how much does £180 get me in car = time /3.14. over 365..."
    but thats just me.

  • yeah, it's nice, right in the bus lane. I would've normally seen it, presuming I was on the ball, but that time a bus decided to overtake me just deftly brushing my elbow so my attention was towards the heavens, hoping my plan of 'repent on my deathbed' could be inacted in the split second before I went under the wheels on the bus, which do actually go round and round, contrary to popular belief.
