Verdict is, at least half of the items being sold Hunterlar does not have the right to sell.
This may not be Hunterlar's fault, as he received the items from another person and is under the belief that they were all legitimately acquired.
To quote a Rapha member of staff who knows the source of the items:
We have an internal policy that uniform, samples and test clothing cannot be resold and is only for personal usage. I realise that's not Hunterlar's fault and is something I need to take up with . However, there are items that are stolen due them never being issued to .
The Hi-vis vest
Sample lapelled jacket
Paris-Roubaix flag.
The fact of the matter is that over half the kit listed is owned by us as explained above (test, sample etc).
As such, Hunterlar is selling some items that do not belong to him, and by definition that means handling stolen property.
It is clear to me that Hunterlar is not an alias for the that wrongfully passed on the items to Hunterlar. And Hunterlar is truly under the impression that all items were legitimately acquired.
So... I won't ban Hunterlar on the condition that any items still in his possession remain in his possession and are not sold as a result of appearing on LFGSS. If a single item not already shipped now ships, then the permanent ban along with disclosure of the identity of Hunterlar to the police will take effect.
Whilst it is plausible that Hunterlar received them in good faith he's fine, but now he knows that the items were not all legitimately acquired and some belong to Rapha, any attempt to sell them will not result in any lenient action from myself.
As to what Hunterlar wants to do with the items, I'd suggest returning them to Rapha if he doesn't wish to keep them for personal usage. I can provide contact details of someone who will accept them.
I understand that Rapha will be speaking to the in time. I've no clue as to what their internal policies are on this and whether or not there will be a shit-storm or a word not to do it again.
OK, thread closed.
