Amongst all the campaigning and other great things, I can't recommend joining BC, CTC, LCC or similar enough for this very reason if you are a regular cyclist. No matter how good a rider you are/think you are, for a relatively nominal fee you are covered and supported in the event of an accident.
From personal experience, where I was involved in an accident similar to the OP'er (taxi pulled up in a no-stopping/no-parking lane to answer his phone), the peace of mind that the insurance covered all costs was a huge relief. It was a big taxi firm, so repairs to the vehicle, loss of earnings, legal and admin fees were all dialled up to the max. It was a few years back and I'd probably still be paying for it now if it wasn't for a BC membership.
From your comments in the other thread no-one will have any sympathy if you're an aggressive rider with poor brakes. It sounds like you're lucky to be dealing with an agreeable driver, so I'd say just get everything in writing and pay up.
