    I am sure there used to be a lot more - I seem to remeber some bonkers wide bodied SECs that I couldn't spot - the site does say its being updated, so hopefully they will return.

  • Two of my friends have been given Section 59s for absolutely pathetic reasons in the past two weeks. Two S59s = seizure of vehicle, there's no appeal process, and there's no evidence required, they can just hand them out whenever they feel like it. I'm not worried but it seems ridiculous.

    Sounds like that law has the potential to be challenged. Government would then be expected to append or repeal.

    My friend who works for the police told me this:

    Now there is a new endorsable ticket, RTA Sec 3 1988 as amended 2013:

    "Driving a mechanically propelled vehicle on a road or public place without due care and attention, or without reasonable consideration."

    Must be observed by an officer where there is no victim, collision and no public complaint.

    £100 and 3 points. Two bits of important wording there: 'public place' so the NCP car park is very much game. Second is the word 'reasonable.' That is I guess an opinion formed by the person observing.

    So that to me would now be a better option for the above. Generally 'boy racer' types doing doughnuts in a car park meet all the avocet criteria (although they do often crash which is hilarious).

    Do that leaves me stumped on the whole section 59 thing to be honest. I'd now see it as a 'lower' written warning but it would seem to me that lately its been miss interpreted perhaps. I've had another member talk to me about a 59 issued in unusual circs.

    I agree with him that if that is in place, the S59 doesn't seem necessary.

    Have a friend sitting in the back of the car not wearing a seatbelt. I briskly came up with the excuse that the seatbelt bolt had snapped off due to rust. Then my friend started gobbing off (never dealt with the law before) and so the office started to pick away at the car....no fog?, no front plate,? are all the mods declared? wheels poking? 3 passengers and 2 seats etc...

    If you weren't driving around in a car that is illegal in at least 4 ways you wouldn't be subject to such scrutiny. You know what the answer is.
