Purchased classifieds items not showing up?

  • Ok so about three weeks ago I bought some power grip straps from the classifieds area, the seller sent them second class and lost the reciept, then they never turned up. So, where I payed £10 he gave me £4 back.

    So about a week ago I buy another pair of straps from another seller (also £10 paid), he also sent them second class and so far no sign.......WTF, what do I do???

  • Well for starters, nobody is allowed to sell on here without offering protection via Paypal. The buyer should not have requested that you send Paypal 'gifts' as payment - this is against the rules. Similarly you should have paid via Paypal 'payment for items' which gives you some protection as a buyer, that is, you can claim your money back if something goes wrong.

    Secondly, losing the receipt is his fault, so IMO he should give you your tenner back and then claim the loss through Royal Mail. I doubt some straps cost £6 to post anyway, so that's a bit unfair.

    I expect this thread will end up incorporated into this thread where you can name-and-shame the seller.

    With regards to the second seller, sometimes second class takes ages - longer than a week, at least. Give it another week, then get in contact. I've had items turn up after a month.

    I sent you a detailed reply about this half an hour ago... they were only sent on Friday so could easily still be on the way and if they've not arrived by the weekend I'll refund you (which will mean I lose the money myself).
    The fact you've had two packages go missing does suggest it might be worth getting in touch with your local post office, checking with neighbours, etc.
    (and from now on I'm definitely only posting stuff registered, but this means postage would have cost a lot more).

    Basic rules for classifieds:
    You must post the classified advert in the Classifieds forum.
    You must use a thread prefix if one is applicable. If more than one is applicable you must select the one that you most wish to happen. I.e. select "For Sale" even if you are also willing to trade but would prefer to sell.
    If you have an item for sale anywhere other than here, like ebay, bikeradar, ctc, retrobike, etc. then you cannot post it here. However, if you have posted it on one of those other sites, other people who have discovered it are allowed to post it in the eBay/Craigslist finds thread. You must not do this yourself.
    No bumping on anything you're offering (for sale or trade)! Exceptions: 1) If you included a price as per the advisory, you can bump the thread to drop the price. 2) If you hadn't added enough information (such as photos) and now want to.
    No fishing expeditions. You are either selling something or you're not. Either it's in the classifieds or it's deleted.
    *PayPal transactions must include buyer protection (sellers are not allowed to demand that money be sent as a "Gift" as this deprives the buyer of any form of protection on their payment).*

  • It doesn't say that you have to use paypal. The seller can also request payment as a gift, they can not enforce it but they can ask, It's upto the buyer to say no.

  • I interpreted the rules thus:
    1) The rule states that "Paypal transactions must include buyer protection".
    2) Therefore the seller cannot partake in a transaction without protection (and nor can the buyer, I suppose) without being in breach of the rules.
    3) As an unprotected transaction is against the rules, you can neither request nor demand that an unprotected transaction takes place.

    The rules go on to say that 'sellers are not allowed to demand Paypal gifts'; I personally think that my use of the word 'request' and David's use of 'demand' are, in this case, implicitly interchangeable given the mechanics of the rule above (i.e. that 'gift' transactions are against the rules full stop, regardless of whether you 'ask' for them, 'request' them, 'demand' them or 'enforce' them).

    Obviously you don't have to use Paypal...

    edit - probably worth saying that I'm happy to be proved wrong on this, either by David's clarification (i.e. is 'asking' against the spirit of the rules; should the rules be changed?) or by yourself. No need to be so aggressive, though.

  • I've offered (and completed) payments as gifts. If I trust the seller I will continue to do so. I don't buy any old shit from any old user though.
    There is no protection for people who send payment by bank transfers or cheque. Why should paypal be so different.

    There is no mention in the OP of how payment was made so your post was a bit presumptious.

    I interpret the rules differently to you.

    I've never had anything show up more than 2 weeks late and I've moved about a bit in recent years so thats why I'm not expecting to see anything from the first seller, but I suppose its not imposible. (if they do I will of course refund the £4)

    I did make both transactions via paypal and they were not gifted so I have payment protection, but I was under the impression that by claiming through paypal it's was like forcing the seller to pay me back?? so I thought as he seamed like a genuine bloke I'd just compromise on the refund with a 50-50 split (which then became £4 for some reason)

    The second seller is being sound so I'm just gonna keep hoping that they're gona turn up for a while longer. If they dont show up I'm going slay some royal mail ass.

    Restraps are too much of a pain in the ass to flip over and get into IMO, rode them for about 5months and they did my head in!....although that did teach me to trackstand pretty well :/ cages are better in this sense but I dont like the cage on my foot, cant hook the retention as nicely.......thus, power grips in flippable pedals.

    I have gifted monies on here as well but to well established sellers, with no problems, normally the forum love is strong.

    Seems a bit unfair to me. Whenever I sell something, I take the view that I'm responsible for the item until the buyer receives it - if it gets lost in the post then I make a claim using my postal receipt, but if I lose the postal receipt then I've got to pay up; I wouldn't want other people to be out of pocket due to my own mistake. I think I'm right in saying that Paypal takes the same view. 50/50 seems generous on your part (and even more so with the missing quid!).

    Or perhaps 50/50 is okay considering it's a low value item. On something of higher value I'd want a full refund, but for a fiver... maybe I'd give them the benefit of the doubt - you couldn't use the same technique to scam someone (speaking purely hypothetically here!) on a high-value item without being found out (or a low-value item more than once or twice). The moral maze gets ever deeper!

    BugBrave - I've just double checked and your Paypal address (which is where I posted to) doesn't match the address in your PM - so I think this might explain the problems... Have messaged you about this as well.
