    Whilst I appreciate that you are in a position to claim for damages through insurance, what happened was a directly due to negligent and technically illegal behaviour. There is a principle at stake here that I think is all too frequently overlooked when the default option is to go down the insurance route.

    Presuming on it's absence from your description, I'm a little disappointed that the police failed to issue even an Fixed Penalty Notice to the driver. Should the driver be involved in a similar incident in the future then without the record on their licence it will be harder to establish a pattern of negligent behaviour.
