I was thinking about the emails they send when KOM is lost, and whether that is a factor in this court case in the US.

If Strava send an email telling you that you lost a segment, they are in effect inciting you to try and regain that segment. If it happens that the KOM record is over the speed limit, they are effectively inciting you to break the limit.
