  • Any advice / info very much appreciated, thanks.

  • the cyclist should give the details of their insurance to the driver and get them to deal with the claim directly.

  • Dont worry, your £80 quid forks are bent , your not. It happens. Dont be arsed with the legal stuff it will only cost you. Live another day and move West

Much further West than Southall and the dragons pick you off as you go about your business.

  • the cyclist should give the details of their insurance to the driver and get them to deal with the claim directly.

I did this with the scenario above Kev's and then later had a phone call from the driver saying I had to get things rolling on my end before they could claim (now done so).

Still mightily bumbling about the processes but thanks for the advice from everyone.

  • Can anyone recommend a good solicitor's to go to if I want to make a claim about an accident that happened a couple of months ago? (in London)

I've seen that Shoosmith's are recommended on LCC but somehow am a bit nonplussed about choosing them before looking around for other good firms; they seem a bit pushy. Not that that's a bad thing but I'd go with a personal recommendation over some kind of deal any day. Anyone had good experiences with them?

Any tips on getting my bike back off of the police would be useful too. Apparently it's in the property store, I've been ringing them over n over and they just never pick up. A mate went in person with all the requisite ID's and was told some mumbo jumbo about only one officer being able to release it; no information as to when that officer would be available, and no response by phoning them either. I'm not in a fit state to fetch it myself just yet either. I'm getting antsy about that 3-month thing. (apparently they auction stuff off after 3 months and it's been 2 already eeeeeeeeek!)

Also if this is in the wrong place and should be a new thread or in a different place please let me know and I'll remedy it. I'm new, but out of the 'nursery' so creating a new thread is fine if that's appropriate.

  • Aha! thank you that's perfectamente!

I'm not au fait with navigating these forums yet. Sometimes the search function works, sometimes it doesn't. Mind you my browser keeps crashing at the mo, probably doesn't help.

  • Thought it might be more appropriate to post on this thread from now... some of you on the reporting dangerous driver to the police thread know I was hit by a van a few days ago. Everything is being taken care of as we speak, but since the visit to the doc, I have noticed more pain and discomfort on my right shoulder and my left knee, both of which took some impact from the crash - I was hit from the right and landed on my left knee (Knee is bruised and shoulder's muscle was pulled or something). However, both knee and shoulder carry old injuries that can flare up now and then. Knee is on the mend but still causes pain at times, shoulder has been stable for a few months. I don't think I need medical attention, but is it important to pop round to the doc again so this could be documented? I can't say if the pains are caused by the old injuries or the crash, or if the crash has made them worse... All I know is I really don't want to cause any more fuss...

  • Yes, get them documented. If you've already seen your GP, and you don't think that it warrants any further treatment, you could have a telephone appointment with them, which gets things onto your record, but may use less of their time.

It's important that thing are on your medical records, as any injury compensation is based on the damage that has been done to you, and what is reported at the time. The claim that you make through the solicitors will be (in my experance) a personal injury claim with items damaged in a secondary schedule. I've been told previously that without the injury claim, I may not be able to claim for the damage to my bike, but I view that advise with a little suspicion.

  • just checked with the practice abt whats been recorded on the note, it says left knee hamotoma, right knee bruise and right shoulder pain, which is pretty much what it is. I can't force them to write an essay about how I think these injuries might have made my old injuries worse, as like I said, I don't know myself... I mean shall I wait for another couple of days to see how it goes?

  • if their notes are accurate, let it lie, if it gets worse, let them know, but keep a dated record for yourself, as contempary notes are helpful I belive. Certainly more helpful than anything written a year later saying 'I had pain for a week afterwards'.

  • Cheers mate, I mint just pop back here everyday to update it. At least it's got time and date on! It might work.

  • stick it in your rider down thread maybe? I'm sure that Velocio will be helpful with server logs if needed, and it keeps people upto date with how you are in one place...

  • That's a good idea, I will do it now. A bit of self pity and feel sorry for myself might just be what I need. :-)

Hi ExTra, Please do go back to the doctor. If you want little fuss, check in with a lawyer who can take care of things for you. If not,you can go it on your own, but it will take some effort. The rest of us on the road are depending on you to make sure this accident gets counted. Good luck. Please email me if you want more help. roxy at roxy erickson dot com.

  • Cheers mate, Oliver from here has already taken on the case. I guess I will just email him and see what he says...

  • Just wanted to say that Oliver Jeffcott has successfully resolved my RTA, so big recommendation from me. I was hit from behind, the bloke denied he touched my back wheel, no CCTV footage (Tescos camera wasn't functioning) and Traffic camera (LTA?) had footage of me on the bike but not the aftermath. No one actually saw it happen, just me hitting the deck - so no witnesses were prepared to give evidence to Police. So just my evidence against his and his passenger, but Police and ambulance were on the scene (broken collar bone) and Oliver got it resolved.

  • My bike was damaged in an accident earlier this week, and I will take it into 2 bike shops this weekend to get a quote for repair costs. The driver has accepted responsibility and I have all their insurance details. I know it probably varies between insurance companies but do I also have to provide receipts for the damaged parts from when they were first purchased?

  • You shouldn't need to provide receipts for the damaged parts as long as the bike shop can give a quote for the cost of replacement parts. PM me if you need any help.

  • I was knocked down yesterday by a van, was hit pretty hard as the van driver didn't see me and tried to squeeze through a gap between the car in front and behind me( didn't exist as I was in the gap). My light was green, he wasn't technically green as he was sitting in a filter lane on the opposite carriageway. He turn right into me last second accelerating quickly whilst I was doing 20mph, I was lucky there was a witness and she left me her details whilst paramedics dealt with me. He was quite sheepish at the scene saying he'll drive me home, he did drive my bike home which I let him do as both the bike and me were pretty beat up. He was quick to leave and left before I did in the ambulance and the police had arrived, the police tracked him down afterwards as they needed a statement. They made it appear like they were on my side as in all fairness I wasn't at fault. He made a comment about the lack of front brake but in all honesty it wouldn't of mattered as he drove straight into me and there was no way of stopping, it happened so quick. One second he was at the line waiting next thing i known he was driving into me.

I'm pretty beat up, I was taken to a&e on a spine board and with a neck brace. I was discharged late yesterday evening (happened at half 1) but left with mild whiplash, a buggered knee and had a lot of skin shaved off it, bruised shoulder and plenty of cuts/bruises all over. I can walk but it's more of a hobble as I can bend my right leg without being in a lot of pain, my bike is pretty beat up too. Frame is bent along with the bars, front wheel and I'm pretty sure the forks are too. It was a hefty impact hit him at 20mph and he was accelerating into me. Pretty sure the bike is a write off so will need to claim for that, helmet did a good job protecting my head and is also trashed, my dad said I have a claim for compensation because of the whiplash and grazes etc plus the inconvenience of not being able to drive, cycle or walk properly.

I know there is a solicitor on here specialising in cycling claims, can anyone point me towards him? Also if anyone has advice etc as to what I need to do now that would be great, I'm pretty sure there is a possibility of the driver being prosecuted for driving without due care and attention.

  • Sorry to hear that man.
    Rest up.
    Good luck.

Thanks roxy, I've been going over information there. I've also been in contact with OJeffcott today, hopefully get things going soon.

  • I had an accident on Tuesday night - I have some injuries; they were assessed by an ambulance crew and I have a copy of their report detailing my injuries. I don't need further treatment.

Is it still necessary to go to a GP to have a record of my injuries, or will the report above suffice?
