No alternative needed, both should happen. But as this bloke managed to brake fast enough to not hit the inattentive nodder, it sounds like he was doing OK.
No it doesn't, it sounds like he was fortunate to avoid a potentially nasty accident. What if they'd pulled out half a second later?
I agree that people shouldn't pull out without shoulder checking, much like people shouldn't open car doors without making sure nothing's coming and pedestrians shouldn't step of kerbs without looking. I'd rather avoid dealing with the consequences of them not doing.
