I might be mistaken but doesn't this also mean it won't be covered by warranty? I thought warranty was only valid for original end-user purchaser? Whether this is the same for goods won I don't know, but If this is the case, it definately is worth your while spending an extra 70 on a brand new one.
Normally within the year Apple (even after the year sometimes) does replace or fix if it's a legitimate issue. No questions asked, no reciept required in my experience and I have done this being the second owner of an iPod as well. Although it is a fair point, I doubt someone would run into trouble as long as it's within the first year...
