Technically yes. Also, intent doesn't come into it. If you opened an email from a friend and there was a photo of his child naked on the beach on holiday or similar you could still be in the wrong. It is one of the sets of rules that are designed to be overly stringent but putting faith in the judicial system to be able to exercise at least a small amount of common sense and discretion where necessary.
