  • like some dick in a van cut me up last month on an empty road, loadas room.... i saw him parked up further up a few mins later so i pulled up an waited for him to get his bakery. He woz a right fat cunt, i said wots ur prob, i woz nowhere near you... fatty replied you should beriding on the pavement.
    i lost it, gaveda prick a helpin hand in (slammed that door hard) an bout to ride off but decisded otherwase... pulled out my chain & banged that fuckers (driverside) window clean out (it showered his face an breakfast :-D) an then rode off.
    Normally i dont give a fuck but this guy reallly was on a trip. it was about 1 degrree so i guess he had the rest of the day to cool off

    your name is quite apt,
    no need to do what you did (if you did it, reads like you made it up) regardless that he cut you up, it will happen a lot, he could have had you for damaging his van or even worse chased after you in the van

  • Quick question, maybe it has already been answer, but should I phone my local police and report an incident or phone the police in the area that it incident happened.

    To put it into context I got hit by a car turning left when I had right of way - basically turned straight into me. He even said it was his fault. Once he realised I was alright he buggered off. Got two witnesses but one is a local drunk man (so not too reliable).

    No serious injuries as my bag cushioned the fall, the tomatoes and milk in my bag were not so lucky. Front wheel is a little funny, looks like it may just need to be re-trued, I hope, and brake handle is a funky angle/

    Anyway, want to report the incident but don't know if I should phone the police near the incident spot (Pimlico) or my local bobbies. Any ideas?

  • Just wonder if anyone can help me with a bit of advice regarding my accident:
    About a month ago I was knocked off as I exited a roundabout. The car struck my left chain stay writing off the frame and rear wheel, the impact with the floor destroyed my saddle and brake levers. The car stopped and after initially loosing my rag in a big way I calmed down and we swapped details. Unfortunately I had not seen this thread till i got back home so took no witnesses. Initially they said I was going too fast (until I pointed out had I been going any slower I would have gone through their windscreen!) then they said I had no lights on (until I pointed out the fact that I had 3!). First of all they said that they would just pay up so not to have to bother with their insurance however after receiving the quote to replace the bike etc they changed their minds.
    After chasing the insurance company for two weeks they have finally come back saying that he is not admitting liability but they will pay out £350 for the bike (about half of the quote) and for a couple of the bits and £250 for my bruising. Is it worth pursuing this or just settle? I have photos of the marks I left on the road so it is clear I had right of way. Will him not accepting liability affect me?

    Contact the police immediately. They will take a full accident report of the scene (probably take them a month or two to get round to it) and the accident from the perspective of both participants.

    Then I also suggest contacting Cycle Aid http://www.cycleaid.co.uk/site/home/ and they can advise you properly on what to do next.

  • Spoke to the police the night of the incident however due to the fact that I did not have a limb hanging off they wanted naff all to do with it! Spose it would not harm ringing them again.

    Hmm didn't they give you an accident number or something like that?

    You should probably go to the police station in person to report it.

  • Yeh was daft and rang the "non-emergency hotline" they did not seem to know what they were talking about. Just cant understand how he can claim he is not liable, hitting me in the side/back as I exit a roundabout!

  • I can't advise you properly, but your bike chain stay getting wrecked is probably pretty good evidence of it being the driver's fault. Don't get your bike repaired. I suggest you phone Cycle Aid tomorrow. When I got hit in July '10, I initially went to a local solicitor's firm in Bournemouth and the guy I got was totally useless, but I am with Cycle Aid now and they are very good.

    In my case, a car pulled out in front of me and I rammed into the side of it. No witnesses. After the police report, the insurers admitted liability.

    1. Don't accept any payment.
    2. Phone Cycle Aid
    3. Go to police station

    on friday the 1st i had an accident on white chapel high st
    got his detail
    got witnesses
    and i could probably even get a tape from the cctv

    yesterday (4 days after the accident) the driver's insurance called me offering me 1000 £ for my knee plus whatever the cost of repairing the bike are going to be...
    its sound a bit dodgy e too easy to me

    any advise?

  • Hi Mitshel. Insurers often make offers of about £1k for injuries, plus losses on top, after an accident. This is to stop people getting proper legal advice on the value of the injury from a solicitor, as the insurers then have to pay the solicitors fees on top, and they should get you more money.

    I would always advise to get a second opinion on the value of an injury from a solicitor, as they will send you for a medical report to properly assess your injuries. You don't know how long your knee is going to be bad for, so I definitely wouldn't rush into settling now - you can't go back for more money at a later stage.

    £1k is about the lowest amount you will get for an injury, and is for minor cuts and bruising, or injuries lasting a couple of weeks. Knee injuries are usually valued higher, depending on how long the injury lasts for.

  • I was hit by a van yesterday. He was pulling out and not looking in the direction he was driving. I was stationary. He did not hear me shout at him as he had headphones in. He shouted at me for a bit and drove off. I was not able to get the reg but got come details about the van. By the time I collected my thoughts I approached cars that were near by and they had not seen it. The witnesses had driven off. I called the police and they said to go and do a self report form. I did this. I don't think there was any cctv but hope there is. I will cycle that way most days and so may see him again if it is his regular route. Is there anything else I can do? The van had BT broadband or BT Openzone and another company name on it so I will contact BT and ask for list of companies.

    Can I claim if it was a hit and run? There is damage to my bike and nerves!

    I had read this post and knew what to do, alas the adrenaline/shock of being driven into/anger meant that I was not quick enough to either chase him down and get his details or walk up and down the traffic appealing to anyone who might had seen something. I now really regret not doing this. So perhaps someone who reads the advice at the top might read this as well, and then not make the mistake I made and just call the police! Perhaps if i'd not read this I wouldn't have even bothered with the police.

  • By failing to stop at the scene of an accident he was breaking the law. This is generally regarded as pretty serious. And yes you can claim, if you can find him. Good luck with tracking him down. If you can find which company it was they may know which van was in the area at the time. I don't know what a self report form is but personally I would want to go to the police station to report this.

    You must identify yourself to any other vehicles whether you have collided with them or not and give them your personal details and your insurance details. Where there is another vehicle involved, you must give the driver of the vehicle your name and address if requested by them even if the accident was not your fault.

    If you do not stop at the scene of the accident for some reason (for instance, because of an irate driver or an unsafe situation), you must report the incident as soon as possible at a police station (within 24 hours) or you will be committing a driving offence. If you have left the scene without exchanging details for whatever reason the police are likely to charge you and it will be up to the Court to decide whether you were right not to exchange your details.

    Nah it still hurts all the bloody time, however I am totally fine cycling. Word from the docs is that it will take 18 months to stop hurting completely (i.e. April 2012). Perhaps on the plus side, I think my pain threshold has gone way up from the constant pain. :P
