No need to get legal advice unless she is going to deny any wrongdoing to the insurance company, if she admits it was her fault the insurance will pay out. If not (and she would be pretty stupid to contest it) then you have 3 witnesses who will back up your story. That should be enough for the insurance company. If they still refuse then I'd be looking for legal advice.
