You're fully entitled to break those rules, but there are other bodies that can fall on you like a big pile of bricks for doing so. The courts, mainly. There are also some interesting, tricky little problems where you could be in trouble in the courts for doing nothing particularly wrong - the code is also designed to protect you in those cases.
