Islington penalty charge notices

  • I have just received a penalty charge for an alleged driving contravention on Marlborough Road N19. Now they have provided proof and although I live in Bristol I suspect it probably was me as my brother lives in that area. My only query is the alleged contravention happened on 25/03/09. Would I have any right to appeal as this is well over 6 months ago. Surely they have to let me know of any fines within reasonable time constraints.

    If you have been stopped by the Police, the Officer can issue a Fixed Penalty Notice there and then on the basis that you agree to that procedure and by accepting the Notice, you would not face a potential "totting up" ban. Consequently, if you have 9 points or more on your licence, the Police will not issue a Fixed Penalty Notice as by accepting same, the motorist would face a "totting up" ban of at least 6 months. It is the Officer's choice as to whether or not a Fixed Penalty Notice will be issued. However, for certain offences, which are felt to be too serious to be punished by way of a conditional offer, a Summons must be issued.

    When the driver is not stopped at the time of the allegation, a Fixed Penalty can be issued by the Process Unit/Camera Enforcement Office, but only when the offender has confirmed their identify by responding to a Notice of Intended Prosecution. As with a Summons, the Fixed Penalty must be issued within 6 months of the offence.

    Looks like I gave it a shimmy round to the right of this bollard, as I say they caught me fair and square, it's just it was ages ago, I can't remember last week nevermind March. Bloody London! I'll just blame my brother.

  • i have definately gotten off a speeding ticket ( my only one ever ) because they firstly send me a penalty notice with correct speed but wrong location, by the time the " updated version " had arrived it was a month or so later the legal notice period had been exceeded

    Is this from camera evidence? Strange that this is seven months later. You sure the summons was issued *after *six months? They could have been trawling around on cameras around the edges of the legal time they can prosecute, looking for someone just like you. And sent the summons right at six months. Perhaps they keep minor offences like that on ice as backup to make up their cash.

    This is really bonkers. I hate the Police State.

  • I was stopped for contravening a no entry zone once, so I booted the copper in the nutz, taxed his helmet, smoked a some budspliff and drove to Dundee in my bare feet. But that was over 10 years ago so I can't prove it.

  • It was over six months, contravention was 25/03/09 and the Date of Notice was 16/10/09. Yes it was from camera evidence. Seems like a long time. Some conflicting information on various forums,they usually have to contact you within 28 days but if Islington have made moves to find out who the owner of the vehicle is within 14 days and the DVLA have just been slow about it then I will be liable to the fine. I can get in touch with DVLA and find out when they enquired. Might be worth sending them an official looking letter pretending to know what I am talking about before coughing up. These motoring forums seem to be full of angrier people than on here.
