Hmmm, well as far as I understand it the data retention regulations are designed to force ISPs etc to keep logs for a minimum of 12 months. These logs don't include the data actually sent, only the time at which connections are made and the IP adresses involved. Simlarly, the same applies to text, email and so forth. Apparently the government thought it would be a nice idea to centralise all this info into one database.
Really though I think there is a large amount of spin being put on this. The central database is almost certainly a waste of money, other than that I don't see much change from what already exists. In the past ISPs have kept logs as have phone companies, it's just that now mandatory requirements are being set forth, presumably because otherwise the companies would rather not keep the logs for that long, due to the expense involved.
With regard to text and phone, this has been going on for a long time anyway. If you're that worried about email, encrypt it. Similarly, do you not think the governement has already been monitoring web traffic? How do you imagine they catch the kiddie fiddlers and so forth otherwise?
When my phone was stolen my network was able to provide details of all the calls that had been made. Similarly, I receive an itemised bill, which is the same thing - every call and text I make. Of course the police can request access too if need be. The police can also find your position from your mobile, again nothing new.
Considering the amount of traffic that is porn, I think that will be the least of their concerns (except stuff involving children and so on). SSH is secure from the point of view of the integrity of data which passes through, but the ISP still knows I connected to so and so server, even if the content is not known (which is all that is being logged anyway).
If you're really worried then even standard encryption can't save you - 128 bit is pretty lame and can be cracked in a few hours with the right means. There are more secure algorithms available, but to be honest why bother unless you have something to hide?
If you really want to hide stuff you still can. Otherwise, it makes bugger all difference, cos the police don't care if I'm chatting about bikes or looking at "hot naked babes".

Yet my hosting company (German owned) sent me a note a couple of years ago stating that they would be deleting server logs over 9 months old due to an EU privacy directive forbidding them from keeping them for longer than that. It's more fucked up than any of you amateurs could believe...
Your ISP has to tell the UK government that you visited my website 12 months ago, but my hosting company must have already destroyed the server log (the actual useful bit) 3 months ago to comply with EU law. On a server located in the UK. It's Orwellian and Kafka-esque at the same time, with a side order of Joseph Heller

Haha, that is funny! Very Catch 22. Similarly, the recording industry has prevented a shit-load of music videos on youtube from being accessible by people in the UK. For example, try typing "hanson mmmbop" into youtube, you will not be able to watch the video. Not that you really wanted to, but just proving a point.
However, since I have a server in the US too, I can use that as a proxy and watch all the Hanson I want! Nice. So it's not legal for me to watch it in the UK, but if I pipe it through via some computer in the US it's fine. Which just goes to show the whole failure of the whole thing - regional settings don't work on the internet!

This was instigated by Youtube not the "recording industry" (no such collective exists as much as people love the conceit) - it's basically a big bun fight between PRS and Youtube (I am a member of PRS so get bombarded daily with updates about the battle).

I'd say, as a people, we have never been freer than we are now.
