The term "statutory rape" comes from the American cinema. Rape is penetrative sexual intercourse per vaginam without consent. Minors cannot give consent. Did you have penetrative vaginal sex with her? Yes, there's the actus reus. Did you mean to have sex with her or did it just slip in? Yes, you meant to, there's your mens rea.

I think statutory rape is a bit more than cinematic fiction.
Chuck Berry served gaol time for it.
What he actually did was to 'transport a minor across a state line'. In the early 1960s in Dixie states this amounted to statutory rape - especially as the girl was white. -

I've just realised that when I posted looking for advice on rare vinyl it was Hacked 2 who was the most help and really went out of his way to find useful information for me. So the guy can't be that bad really even if he does have an odd tendency to threaten to sue people.

I thought that there was no "mens rea" when the other party purported to be able to give consent (i.e. by pretending to be over 16) and the "actus reus" was sufficient.
Yet another reason why I'm not a lawyer.

I'd be interested to see this go to court, given that some of his bikes were illegal on many levels (sold without adequate reflectors, bells, etc).
If he wants to be a dick, phone trading standards and get them to assess the legality of the bikes he's selling. Oh, and as he's trading and has been for a while, anyone want to phone HM Revenue & Customs to check whether he's registered the business with them? He's probably going to face a couple of hundred in penalties (not to mention unpaid tax, with interest) if he's not.

Kill your livelyhood? I was merely pointing out that there remain some questions about the legality of what you do. If it turns out that you're not obeying the law, then it is entirely your fault.
If you go around threatening to sue people for quite rightly pointing out that some of the bikes you have sold in the past are dangerous, you have got to expect this sort of thing.
