I think the law states something on the lines of giving them half a chance. like a few seconds head start. and providing you have given them a bit of warning you can take them out.
Several important and clever acts or parliment have passed in recent years to relax these laws. one of these included the amount of warning given to a pedestrian on their ipod or phone. I believe (but don't quote me here) you have to give them some kind of verbal warning anytime before or up to 5 minutes after making direct head on contact with them.
