in "real life" he should just give you whatever you ask for
but if it helps you form your negotiating position, if it went to court, you'd probably only get damages (to the value of what you'd have if everything had gone to plan). but, you could get the specific cranks you want if you could show that simple damages weren't enough - if substitutes aren't readily available, or if the thing you lost was of unusual rarity (like a ming vase).
this is of limited use to you but i'm in a library on a friday night til it closes so give me a break!!

jesus. that is totally extracting the michael, angle grinder to remove a totally fine chainset!!!!!!!! I was only half joking about the joint splitter/spanner method as it can damage bits, but not THAT much!!! Even if you don't have an extractor there are 3 or 4 methods (that I know of) that are less destructive.
Another point to raise if they don't budge may be to ask why they used such a destructive method opposed to the alternatives? - Criminal Damage = A person who without lawful excuse destroys or damages any property belonging to another, this includes intent to damage as well.

Basically, BLB was (in legal jargon) the bailee of your cranks, and owed you a duty of care. They should have called you before grinding them. They didn't, so they are in breach of that duty.
The 165 vs 170 things smells fishy to me. Look for more historic auctions so that you have a representative sample, don't rely on just one. An average of ebay auctions seems to me to be a legally robust market pricing of a second hand good.
PS. Don't let them fob you off with 'it was the only way to do it'. You did not assign them the right to destructively remove the cranks, they would have had to have called you and asked for permission, and given you the option to take your bike to an alternative LBS.

speak to jan, in the morning, (he might have had a drink by the afternoon) explain it calmly. I had a headset done by them, they sold me a brand new one and chewed the edges of it by using the wrong size wrench. I had brought stelle there and another friend and told him, i recommended him to them and they did this kind of shit work, his answer was. "what would you like, you must have a price in mind." I said i didnt but it wasnt good enough, eventually i said i wanted a tenner off the next service i go there. He said no problem. When i broke a couple of spokes and took my wheel there, jan wasnt in i regaled my story to the girl, who replied "well i don't see why you'd lie" and discounted me the 10. They don't do the best of jobs, but they are a young shop and i pointed out to them they need to care for their customers, he agreed hence the 10r. It was a dumb thing to do but Jan is decent and i reckon will sort you out, if your reasonable about your argument. Anyway, i havent been back since my discount cause i can fuck my bike up all by myself and for free.

brendan, I'm expecting a call back from BLB as soon as Jan is back from his trip to Mexico. If I haven't heard anything by monday/tuesday of next week (I think that's when Jan is getting back), I'll head back in. Still coming to polo on sunday?

All the legal stuff is fine and dandy, but surely all you have to do is show Jan this thread and he'll realize that there are several hundred free-spending, fixed-gear-riding customers waiting to see him do the right thing here or they won't be spending any more money in his shop.
£200 in compensation for you in return for keeping all of our business = no-brainer bargain for him.

Keeping all our business! Are you serious? There are loads of fantastic LBS' out there, with knowledgable, friendly, helpful staff. With all the shit that is constantly being reported about BLB, why would you consider going there. If you live near Brick Lane, go to the Fixed Gear London guys.

I'm not sure why but I always feel kinda uncomfortable in BLB. Cavendish is much friendlier

If previous experience of BLB/this forum is anything to go by, Jan couldn't care less what gets said on the Internet about his shop. It's a weakness,but people keep forgetting that fixed wheel riders aren't his sole source of trade, and that there are probably twice as the number of fixed riders that go to his shop who aren't on this forum.
