h2o In my unscientific opinion, the choice of words, tone of voice and understanding of the law expressed in both emails is so close that I'd wager they were written by the same person. In particular I'd point out that in the second email he says "at this point we really do not feel this is worth pursuing" - which to me is highly suggestive of a continuity of thought between the first email and the second.
Not that I could prove that in a court of law - it's just a hunch. I write for a living so I spend a lot of time thinking about how people put one word after another, but at the end of the day I'm just another punter sticking his oar in.

Also I don't think I've seen any posts having a pop at his sexual orientation or his deafness or for that matter any death threats.

No stress at all really. From the start I knew there was nothing that was going to be done to me personally. I've run forums for over a decade and have faced a lot of legal threats, and 99% of them are unfounded, in the wrong jurisdiction, aimed at the wrong entity or just laughable (the funniest ones are the ones who threaten to sue for 'hotlinking'). It's kinda laughable.
I hadn't read everything posted though, so didn't actually know if any post did contain defaming content. I was a bit worried that they might actually try and sue someone on here. Though how they'd get your identity to sue I don't know.

In light of this;
*The content of certain posts on various threads on your forum probably do go beyond the acceptable boundaries of free speech and legitimate criticism. I am referring to several gratuitous and irrelevant unfarourable references to Tony Malone's deafness and sexual orientation...

This comment is neither defamatory or negative in nature, for it to be viewed as such would require a slur on the comments original and sarcastic intention.To bring any form of legal action over this comment would require severe ignorance over my own sexuality.

i went in there about 2 weeks ago to get my chain fixed and they were very busy but still sorted me out and had a chat about my frame. they've also got some beautiful bikes and frames on display at the front of the shop i dont remember them being there before. i think its too soon to say if witcomb is being destroyed, i was pissed when the prices went up as well but maybe they would of had to close down if they kept the prices at the old level
