Glad all is well at least them injuries are not self inflicted like my stupid crash ;).
Difficult to say deps on road positioning I would say. If he had to cross a dashed line and you didn't I wold say it is more on him than you but difficult if you you poped round the car. We need a diagram for our unqualified legal advice.
