  • It's minor thing, but the fine is up to £18 million or 10% of turnover, which ever is higher.

    This rule is likely there to make sure the penalty for a Facebook or tiktok is really chunky. The problem is, it is also mad scary for anyone else, even those not turning over anything.

  • Do we really need email notifications? I'd happily sacrifice some functionality to maintain the site.

  • Yes, this seems like somewhat an overreaction. There are parallels with HASAWA here, which the consequences for breaking are up to an unlimited fine and two years in prison... Doesn't mean that every report of dodgy H&S practices results in this outcome. It also doesn't stop accidents but people/organisations that have followed the various guidance/ACOP's don't then get prosecuted.

    I think actual legal advice would be the way forward here - I'm struggling to see how legislation could be weaponised by a private citizen without seriously compromising themselves, and a prosecution requires not only dodgy content but a failure to deal with it. I can understand not wanting to be personally liable (who would) for X thousand users content though!
