Perhaps you have misheard something at court. You say the Magistrate noted the defendant was clearly guilty - therefore an offence occurred. The part about 'good reason' in relation to the arrest is a legislative point and relies on PACE where the necessity for arrest are detailed - these cannot be made up by the Police there are clearly stated in the legislation. If there was fault on the Police in relation to the actual arrest, it would be easily seen and recorded.

He was arrested for obstructing the police, but never charged with it. He was taken to the station and booked in by the custody sergeant. IMO it was a wrongful arrest but the custody sergeant approved it. While he was being booked in he said the arresting officer was a batty boy. That's the only thing he was tried for. And it was on video - it could not be disputed.

It was awful - that's when he was assaulted and sexually assaulted by the arresting officer. He could have appealed. But that route carried so much potential risk and publicity. After a year of being bound over he got his 'good character' back. No stress. It was the best solution for him. It wasn't the best outcome for dealing with the officer, who may have many other victims. You can't win 'em all.

Yes, custody had cctv, so there was a clear recording of the homophobic slur. But there was not a clear video of the arrest, which was on the street. That's when he was assaulted and sexually assaulted.
