Yeah, that's the case with some sites (that have been coded correctly). Most websites probably just added the stupid popup as an afterthought so it does nothing much to rendering of other bits and in some cases it does nothing to stop cookie dumping in the first bloody place - they ask for permission after the cookies have been shipped. I know, coz some of ours were like that for a while :)
