Because they're good tyres and they were free and the 40mm one fits fine on the back, and it's barely a few cigarette papers off it being OK on the front. There's heaps of clearance laterally it's just the vertical plane where it doesn't quite work.
The clearance will actually improve in time when the tread wears down anyway.
