But not higher than Kanes foot, so was kanes foot there also 'highly risky'? It has to be on that logic.

So based on the fact Kanes was higher first, free kick for Netherlands surely?

Kane played the ball. If it had been the other way around, no one would've complained if the Netherlands got a foul.
