  • I’m contracting as a sole trader for a global corporation (there’s a long story for why not as an LTD). My contract ends soon. I’ve not received an IR35 determination from them, although I made multiple attempts to get one. If they don’t give me a determination, what happens next? If I’m determined to be within IR35, would the taxes be paid by the client additional to my day rate, or would I have to reimburse them? If I’m outside IR35, but being paid as a sole trader, is there any benefit over being inside IR35?

  • IR35 does not apply to sole traders.

    The company you are working for should have determined your employment status at the start of your contract. I would speak to your accountant if you have one and follow up on the reasons you ate operating as a sole trader with the company you are contracted to as I'm pretty sure under the most recent legislation the responsibility / liability is theirs
