  • this is pretty blatant racism @bq, you've just gone and generalised an entire population by race and attributed a negative trait against that population. I assume you see it too.

    you have been here a long time, so no ban hammer... but a strong warning that truly I do actually ban for racism. please edit your post.

  • I have two thoughts on this. I am not a lawyer, so the first one is simply a hunch.

    1. I think the fact you bought the land without challenge from this chap, on adverse possession grounds, surely resets the clock to 0years. Ie he’s missed his chance.
    2. You’d be naive to think there will be any financial contribution from him.
  • Law of adverse possession has changed. Look up how it has changed.

    1. A solicitor friend on the school run basically said (which I already have done). Get the previous owner to sign a document that states all the people and land involved by their full names and Land Registry Title numbers and says that she gave permission for him to use her land to graze his horses and contacted him to inform him on x date that she revoked permission as had transferred the land so he would be required to secure his own land belongings and animals. That would beyond doubt set the clock back to zero!
    2. I agree- It will take a bit extra money and time but my hope is that once I’ve secured my land - and fenced his animals off my land - and cleared the area he’ll just respect the boundary and simply drive onto his own land and do what the hell he wants on it!

  • Another thought… adverse possession has to be exactly that - without permission.

    It reads as if your seller gave this chap permission. I don’t think he has a chance.

  • Is the land in question registered with the land registry? If so it's pretty hard for an adverse possession claim to succeed

  • Yes it is - both pieces are. It seems like, especially now, he’s got no chance and it’s one thing being difficult and quite another essentially and lawfully succeeding in claiming someone else’s land. Had a look at new (since 2002) legislation and seemingly the fact the previous owner has written and signed a document saying she gave him permission to use the land and the fact it’s changed ownership and that there is lots of evidence of me on the land and clearing it and putting in planning and contractors quote’s basically show he’s not the sole occupier of the land.

    Edit: previous owner also has messages between them relating to the land

  • I disagree on both the accusation of racism (travellers are not a race) and generalising against an entire population (they are a minority of a larger population) but I have edited the post.

    Whether it's racism or prejudice against the group, the comment came across as shitty.

  • You may disagree, but the Equality Act of 2010 recognises Romany Gypsies and Irish Travellers as distinct ethnic minority groups. So in the eyes of the law, your comments were racist and discriminatory.

  • I made no reference to either Romany gypsies or Irish ethnicity.

  • You didn't need to, the person in question was described as part of the traveller community, you made a negative generalisation about the person's community, whether they're Romany, Irish traveller or neither, it was unnecessary and shitty.

    On the other hand, he was only speaking out loud a consideration which a lot of people would take into account when doing due diligence on a property transaction. It might be unfair to the individual, but that's the nature of statistical methods.

  • Also, if you read up, their piss-taking antisocial behaviour had already been demonstrated and described. This individual has dumped "rubbish, scrap material and rotting vehicle" on the land and was described as being "from a well known traveller community" (my emphasis), and it was further stated that "in my experience, many within that community have a 'greater than typical' understanding of issues relating to land possession etc" which was clearly a veiled reference to trespassing and other antisocial land occupation.

    But you didn't fucking call that out did you?

  • I made a reference to the chap's "community" meaning his actual community - the one described by @Pasty_Spumante, and suggested he just sell the bloke the land and buy somewhere else.

    But no. The typical hand-wringers and grasses took this to mean "everybody who has ever lived in a caravan", and the knee-jerk pile-on ensued which says more about their own prejudices if you ask me.

    The people that travel around and stay on various bits of land are probably quite aware of the issues relating to the land they stay on.

    Those comments could probably be read negatively, but don't have to be. What you posted was hard to not read in a shitty way. It's gone now anyway so nevermind. I'll go back to wringing my hands until I get the chance to jerk my knees and pile on someone else's shitty comment with three words.
