That said s12(5) does not mention reasonable costs, but costs of sale, so wouldn’t appear to be an avenue through which to reclaim outstanding funds for incomplete work. More so auction listing fees etc.
12(5)(b) would cover costs incurred in respect of failure to collect the goods specifically.IA(extremely)NAL
Hypothetical at this stage but uncollected goods /Torts act... As an involuntary bailee who has tried to trace the bailor / given notice of intended sale of their equipment - if I were to sell the tools and owe that money to the bailor less costs, what are reasonable costs? Especially if the job is 50% finished and I've paid for 75% of it? And if I can't trace the bailor to give any money to, what happens to the money then?
